Terms and Conditions of Rental Agreement
Effective Date: February 2025
1. Agreement Overview:  This Rental Agreement ("Agreement") is made between Joyful Moments Party Rentals ("Company") and the undersigned customer/ purchasing party ("Customer"). By signing this Agreement, the Customer agrees to the terms set forth herein.
2. Rental Equipment:  The Company rents out various equipment, including but not limited to cotton candy machines, bounce houses, chairs, and decor ("Equipment"). The Customer acknowledges that they have selected the Equipment they wish to rent based on their own personal judgment.
3. Use of Equipment:  The Customer agrees to use the Equipment in accordance with the Company’s instructions and safety guidelines. The Equipment may be operated by the Customer or by Company personnel, as selected by the Customer at the time of rental. 
4. Liability Waiver: The Customer acknowledges and agrees that the use of the Equipment is at their own risk. The Company shall not be liable for any injuries, damages, or losses incurred during the rental period, regardless of whether the Equipment is operated by the Customer or Company personnel. 
5. Customer Responsibility:  If the Customer chooses to operate the Equipment themselves, they fully assume all risks associated with such operation. The Customer agrees to indemnify and hold harmless the Company from any and all claims, damages, or liabilities arising from the Customer’s use of the Equipment.
6. Condition of Equipment:  The Customer agrees to inspect the Equipment upon delivery and to notify the Company of any existing damage or defects. The Customer is responsible for the Equipment from the time of delivery until it is picked up by the Company.
7. Payment Terms:  The Customer agrees to pay all rental fees as specified at the time of booking. A deposit may be required at the time of booking, with the balance due prior to or at the time of delivery. All payments are non-refundable.
8. Cancellation Policy:  Cancellations must be made at least 2 days (48 hours) in advance of the rental date for a full refund of the deposit. Cancellations made less than 2 days in advance will forfeit the deposit.
9. Governing Law:  This Agreement shall be governed by and construed in accordance with the laws of the state of Nevada.
10. Acknowledgment:  By completing the checkout process and making payment for the rental, the Customer acknowledges that they have read and understood this Agreement and agree to be bound by its terms.
